Terms of Service

1. Who We Are

New Era Apps is operated by Gear Guardian LLC ("we," "us," "our"), an Oregon limited liability company. These Terms govern all builds, demos, and services purchased through rankbotapp.com, AXIOM Builder, or any linked payment or intake system.

2. What We Provide

We design and build custom web-based and progressive web applications ("PWAs") for small businesses based on the specifications you provide through the AXIOM Builder tool and/or the build intake form. Available tiers, current pricing, and what each tier includes are listed on our site at the time of purchase and may change without notice for future orders.

• Quick Book Mini App — a single-page mobile app with one core feature and your branding.
• Starter — a working multi-screen app with a small number of core features.
• Standard — a multi-feature app tailored to your business, branded to your specifications.
• Pro — a full custom build with the complete feature set you select, delivered within an estimated two-week build window from the date we receive your complete intake information.
• Monthly Care — an ongoing subscription covering updates, hosting, and support for an existing build.

Demos generated through AXIOM Builder before purchase are illustrative previews only. They are not the final deliverable and may differ from the finished build in appearance, structure, or functionality.

3. Payment and Deposits

• Payment is processed through Bluevine, a third-party payment provider. We do not store your card information.
• For Standard and Pro tier builds, the amount charged at checkout is a deposit, not full payment. Any remaining balance is due upon completion and before final delivery/handoff of the build.
• Quick Book and Starter tier prices reflect full payment for that tier's scope.
• Monthly Care is billed on a recurring monthly basis and may be cancelled at any time; cancellation stops future billing but does not refund the current billing period.

4. Build Process and Timelines

Work begins once we receive your completed build intake form. Timelines (including the "2-week" estimate for Pro builds) begin from that point, not from the date of payment, and assume timely responses from you when we need clarification, content, or approval. Delays in providing requested information, logos, content, or approvals may extend the delivery timeline accordingly. Timelines are estimates, not guarantees.

5. Revisions

Each tier includes a reasonable number of revision rounds to align the build with your original request as submitted on the intake form. Requests that meaningfully expand scope beyond what was originally submitted may be treated as a new order or quoted separately.

6. What We Don't Guarantee

• We do not guarantee any specific business outcome, increase in sales, customer engagement, or search visibility as a result of using our apps.
• We do not guarantee uninterrupted or error-free operation of any third-party platform we build on or integrate with (Vercel, Netlify, Bluevine, app stores, etc.), as these are outside our direct control.
• Builds are delivered as functional web-based/PWA applications. We do not guarantee native App Store or Google Play Store listing or approval unless explicitly scoped separately.

7. Ownership

Once a build is paid in full and delivered, you own the rights to use the specific application built for your business. We retain the right to reuse general templates, code patterns, and non-client-specific components in future builds for other clients. Your business name, logo, and content remain your property at all times.

8. Cancellations

You may cancel a build request at any time before work begins for a full refund of any deposit paid, minus any payment processing fees already incurred. Once work has begun, deposits become non-refundable, as outlined in our Refund Policy.

9. Limitation of Liability

To the fullest extent permitted by law, Gear Guardian LLC's total liability for any claim arising from these Terms or the Service is limited to the amount you actually paid us for the build in question. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.

10. Changes to These Terms

We may update these Terms from time to time. Changes will apply to orders placed after the update date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
